With Older Age Comes Added Responsibility – Erfenis Wetgewing T.O.V. Strukture

 
Eienaars van grond is tot ‘n groot mate bewus watter beperkings daar rus op hulle eienaarskap van daardie bates. Meeste beperking word normaalweg daargestel deur munisipale verordeninge, bou-kodes en titelakte voorwaardes waarvan eienaars meestal bewus is. 

What many owners are, however, not aware of is that before commencing any building alteration or demolition, the landowner should also establish whether the structure being altered or demolished is older than 60 years.

In terms of the National Heritage Resources Act, “no person may alter or demolish any structure or part of a structure which is older than 60 years without a permit issued by the relevant provincial heritage resources authority.”



‘n Grondeienaar sal dus aansoek moet doen om 'n permit vanaf Erfenis Wes-Kaap (Heritage Western Cape, in Engels), die statutêre erfenisowerheid vir die Wes-Kaap, alvorens enige van die volgende aktiwiteite met betrekking tot 'n struktuur, of deel van 'n struktuur, mee ‘n aanvang geneem word:
  • Die verf daarvan;

  • Enige vorm van pleisterwerk;

  • Enige handeling wat die voorkoms of fisiese eienskappe van die struktuur kan beïnvloed;.
The Act defines a “structure” as any building or work fixed to the land, and includes fixtures and fittings as well as associated equipment.

Failure to obtain the relevant permit can result in a fine, imprisonment for a period not exceeding two years, or both a fine and imprisonment.

Dit is belangrik om daarop te let dat daar geen afsnydatum is vir die 60 jaar wat gebruik word om te bereken of 'n permit vereis word nie. Dus, enige aktiwiteit met betrekking tot 'n struktuur wat in 2019, 59 jaar oud is, sal nie 'n permit vereis nie. In 2021 sou so 'n struktuur egter ouer as 60 jaar wees en sal 'n permit beslis nodig word vir dieselfde aktiwiteit aan dieselfde gebou.

The Supreme Court of Appeal dealt with certain aspects relating to the National Heritage Resources Act. After hearing the argument of appellant’s counsel, the court ordered that a permit can stipulate conditions which the landowner must follow.

In die onderhawige geval, waar Erfenis Wes-Kaap en die Stad Kaapstad, mede-respondente was, wou die eienaar 'n gebou op sy erf in Vredehoek sloop. Aangesien die gebou egter meer as 60 jaar oud was, het hy, heel tereg, aansoek gedien en toe die nodige permit verkry. Die permit het egter sekere voorwaardes bevat waarmee die eienaar glad nie gediend was nie.

In light of this decision current and future property owners, as well as property investors and developers, should note that:
  1. A permit is needed to alter (even paint) or demolish a structure older than 60 years; and,

  2. Various conditions may be imposed, which can restrict the initial plan that the owner had in mind for the property.
Die voormelde Hof het ondermeer bevind dat voorwaardes wat kragtens die erfenis wetgewing opgelê is nie ongrondwetlik in ooreenkomstig artikel 25(1) van die Grondwet nie, omdat die wetgewing algemeen geldend is en die oplegging van voorwaardes nie arbitrêr geskied nie.

It would thus be advisable should one wish to acquire any older building that requires renovation or to be demolished:
  • to establish whether or not such building is older than 60 years or not;

  • and if it is, to make the acquisition subject to you being able to obtain a certificate from the heritage agency with the assistance of the seller which, if granted, would not preclude one from undertaking that which is intended.

Ons kyk na die verwikkelinge tot op hede. Hoe ver is die voorgestelde nuwe wetgewing gevorder, en waarvoor gaan dit voorsiening maak? Is dit moontlik om nou reeds ‘n ingeligte raaiskoot te maak oor hoe die eindresultaat gaan lyk?
