Die reg op privaatheid is 'n fundamentele reg wat verskans is in ons Grondwet. Hierdie reg omvat ondermeer ook die reg op die beskerming teen die onregmatige versameling, bewaring, verspreiding en gebruik van enige persoonlike inligting.



In addition to this, the Protection of Personal Information Act (POPI) promotes the protection of personal information processed by public and private bodies. It is a comprehensive Act which protects the integrity and sensitivity of private information and which will apply to any information regarding clients or suppliers, contact details, correspondence, human resources and payroll data, curricula vitae, applications for employment, CCTV records, performance reviews and internal email records. Contravention of the POPI Act can result in fines of up to R10 Million or 10 years in jail and entities may be required to pay out significant sums in damages too.

Employees on Probation: Can You Dismiss for Poor Performance?

You decide to hire a new employee, but neither of you is entirely sure that the “fit” will be right. Will the job suit the new hire and vice versa?

The good news is that our law allows you to employ someone new on a probationary basis precisely so that you can determine suitability, but beware – that does not mean that you have carte blanche to dismiss him/her at will during the period of probation. In fact if any form of corrective action should become necessary you have to ensure that it is “fair” in every respect. 

Let’s have a look at how you should go about doing that, at the applicable Code of Good Practice, and at a practical example recently decided in the Labour Appeal Court.

“Verkopersberou” en “Onderhewig aan die Verkoop van die Koper se Eiendom” – Kan ‘n transaksie hierdeur in die wiele gery geword?
Die Feesseison bied ‘n ideale geleentheid om residensiële eiendom te koop en te verkoop. Indien jy op die uitkyk is vir ‘n huis - of reg is om jou huis te verkoop – hou in gedagte dat beide “verkopersberou” en kooptransaksies met opskortende voorwaardes (soos “onderhewig aan die verkoop van die koper se eiendom”) deesdae meer algemeen voorkom.  

Beide kopers en verkopers moet verstaan hoe maklik of hoe moeilik dit vir ‘n verkoper is om uit ‘n oorhaastig getekende ooreenkoms te kom. 

Ons bespreek ‘n onlangse uitspraak van die Hooggeregshof, waar drie belangrike vrae hieroor aangespreek word. Die vrae is voor die hof geplaas deur ‘n berouvolle verkoper wat die gevolge van haar ondertekening wou ontduik.
