LEGAL PRATICE COUNCIL:
Nuwe bestel vir alle Prokureurs en Advokate

The Legal Practice Act 28 of 2014 (LPA) (with some exclusions) has become law as from 1 November 2018.

Dit beteken dat alle praktiserende prokureurs voortaan nie meer onderskeidelik deur die vier provinsiale Prokureursordes of die onderskeie Balie rade beheer word nie, maar nou onder die beheer staan van die nuut gekonstitueerde Regs-praktykraad of “Legal Practice Council” (LPC).

The Law Society of South Africa (LSSA), will continue as a voluntary body to represent, support and assist all practising attorneys, the Black Lawyers Association and National Association of Democratic Lawyers as constituent members together with provincial attorneys' associations (which replace the four provincial law societies) but the LSSA will no longer have control of practising attorneys as that function now vests in the LPC being a creature of statute under control of the Department of Justice of the National Government.

Hoofstuk 2 van die LPA is reeds op 31 Oktober 2018 in werking gestel en die LPC is onmiddellik saamgestel. Die verkose ampsdraers wat verkies was is volg: Johannesburgse prokureur Kathleen Matolo-Dlepu en Johannesburgse advokaat Anthea Platt SC, onderskeidelik as voorsitter en ondervoorsitter. Die lede van die Uitvoerende Komitee is Greg Harpur SC (advokaat), Trudie Nichols (prokureur), Lutendo Sigogo (prokureur), Jan Stemmett (prokureur) en Phillip Zilwa SC (advokaat). Die Nasionale Forum oor die Regsprofessie is aangevul.

The rest of the LPA was thereafter implemented on 1 November 2018 (with certain exclusions, including most of s. 35 which relates to fees). The Attorneys Act, 1979 was also repealed as a consequence and the statutory provincial law societies abolished. The LPC will take over the provincial law societies' staff and assets and commence to regulate the legal profession (attorneys and advocates).

		It’s “13th Cheque” Time Again: Must You Pay Annual Bonuses?
		Can it really be “Silly Season” time again? Seems like just yesterday we were all celebrating the birth of a brand-new 2018… The reality of course is that Year End is now just around the corner, and for many employees that means rapidly-growing expectations of an annual bonus. 		Travelling Abroad? Know Local Laws or Risk Jail
		You are arrested in a foreign country and told that you have contravened the local laws. You face prison, or worse. “But I acted totally innocently” you protest “that’s legal in South Africa; I had no idea it was different here”. “Tough”, replies the stony-faced local law enforcement officer, “you should have found out what our local laws and customs are before you came here”. An official government warning to do just that follows reports of a death sentence imposed by Vietnam on a South African drug smuggler. We discuss how the warning applies to you and not just to drug smugglers, the dangers of ignorance, and of how to protect yourself from arrest and prosecution.

Wanneer is ‘n skuldenaar “Insolvent”? Die Geval van Agterstallige Onderhoud dien as Illustrasie
Hetsy ‘n onderhouds-wanbetaler of ‘n algemene skuldenaar geld aan jou verskuldig is, bied ons reg aan jou ‘n reeks invorderingsopsies. Een daarvan is ‘n aansoek vir sekwestrasie. Dit bly ‘n drastiese stap. Dikwels sal ‘n skuldenaar probeer om te betaal, anders verloor hy/sy beheer oor sy/haar eie sake. Wat moet jy bewys ten einde met so ‘n aansoek suksesvol te wees? Hoe bewys jy dat die skuldenaar werklik insolvent is? Ons kyk na ‘n uitspraak van die Hooggeregshof ter illustrasie. Hier het ‘n ma met ‘n eis vir agterstallige onderhoud van R228,000 geslaag met haar aansoek vir sekwestrasie teen haar voormalige man.
